Participant Release of Liability

Be Strong LLC - Purchase of Day Pass. Agreement to Release of Liability.

By purchasing the Day Pass offered by Be Strong LLC (CrossFit BloNo, Bloomington Strongman, Be Strong, Drew D. Whitted), the buyer acknowledges and agrees to the following terms:

1. Acknowledgment of Risks: The buyer acknowledges that participating in the activities at Be Strong LLC involves inherent risks, including the risk of injury, disability, or death. While precautions and safety measures are in place, the buyer understands that some risks may still exist. The buyer willingly assumes all known and unknown risks associated with participation and accepts full responsibility for their involvement.
2. Compliance with Terms and Conditions: The buyer agrees to comply with all stated terms and conditions for participation as outlined by Be Strong LLC.
3. Release of Liability: The buyer hereby releases Be Strong LLC (CrossFit BloNo, Bloomington Strongman, Be Strong, Drew D. Whitted), their officers, official agents, employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for Be Strong LLC activities, from any and all liability for injury, disability, death, loss, or damage to person or property that may occur during participation in the activities, whether arising from the negligence of the released parties or otherwise, to the fullest extent permitted by law.
4. Indemnification: The buyer agrees to indemnify and hold harmless all the released parties mentioned above from any and all liabilities arising from participation in the activities, even if such liabilities arise from the negligence of the released parties, to the fullest extent permitted by law.
5. Equipment Use: The buyer acknowledges that the equipment used during participation is the property of Be Strong LLC or other participants. The buyer understands that using equipment for purposes outside of its designated function may result in injury and damage to the equipment. The buyer hereby assumes all responsibility for any injuries caused by improper equipment use and accepts liability for any damage caused to equipment owned by Be Strong LLC or other participants due to their misuse or negligence.
6. Use of Name and Likeness: The buyer agrees to allow Be Strong LLC (CrossFit BloNo, Bloomington Strongman, Be Strong, Drew D. Whitted) to use their name, image, likeness, photograph, audio, and/or video recording created during Be Strong LLC activities for advertising, publicity, and promotional purposes without compensation. The buyer grants Be Strong LLC, its affiliates, and their agents the rights to use such materials anywhere in the universe until the end of time. The buyer releases Be Strong LLC, its officers, directors, employees, agents, affiliates, and all other parties in interest from any present or future claims, damages, grievances, or causes of action arising from or in connection with the use of said materials.
7. Modification and Copyright: The buyer consents to Be Strong LLC (CrossFit BloNo, Bloomington Strongman, Be Strong, Drew D. Whitted), its officers, directors, employees, agents, affiliates, and all other parties in interest modifying, copyrighting, publishing, using, selling, or assigning any photographic portraits or pictures of the buyer, whether apart from or in connection with written printed matter, story, or news items, for trade, advertising, or any other purpose in conjunction with the buyer's own or fictitious name. The buyer waives any rights to inspect or approve the finished product or advertising copy associated with the use of said materials.

By purchasing the Day Pass from Be Strong LLC, the buyer affirms that they have read and fully understand the terms of this Release of Liability and agree to be bound by its terms. The buyer acknowledges that this agreement is legally binding and enforceable.
